1. Acceptance of Services
By accessing our website or purchasing our radio and web hosting services, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our services.
2. Description of Services
We provide digital infrastructure services, including but not limited to:
- Radio Hosting: Provision of streaming bandwidth, AutoDJ features, and server space for audio broadcasting.
- Web Hosting: Server space, DNS management, and maintenance for websites.
Note: We do not sell physical goods. All transactions are for the right to use our digital service platforms.
3. User Responsibilities & Content
You are solely responsible for the content transmitted through our servers.
- Licensing: For radio services, you are responsible for obtaining all necessary music royalty licenses (e.g., ASCAP, BMI, PRS).
- Legality: You may not host or stream material that is illegal, defamatory, or infringes on third-party intellectual property rights.
- Security: You are responsible for maintaining the confidentiality of your account login credentials.
4. Service Level Agreement (SLA) & Maintenance
While we strive for 99.9% uptime, service may be occasionally interrupted for:
- Scheduled maintenance.
- Emergency repairs.
- Failures of upstream internet service providers. We are not liable for any data loss or financial loss resulting from these interruptions.
5. Payments and Cancellations
- Billing: Services are billed on a recurring basis (monthly/annually).
- No Refunds: As these are digital services consumed upon provision, we generally do not offer refunds once a billing cycle has begun.
- Termination: You may cancel your service at any time through your client portal. We reserve the right to suspend accounts for non-payment or violations of these terms.
6. Prohibited Use
Our services may not be used for:
- Bulk unsolicited emailing (Spam).
- Hosting “warez,” pirated software, or malicious scripts.
- DDoS attacks or unauthorized probing of other networks.
7. Limitation of Liability
To the maximum extent permitted by law, Online Radio Hosting shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or use, arising out of the use of our hosting services.
8. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the service after changes are posted constitutes your acceptance of the new terms.
